Terms of Use
Effective: 2026-10-29
These Terms set out the conditions for using Ferrynear (ferrynear.com, the "Service"), operated by Diplat Laps Co., Ltd. (the "Company"), and the rights and obligations of the Company and its users.
This English text is a translation for convenience. If it differs from the Korean version, the Korean version prevails.
Article 1 (Purpose)
These Terms govern the rights, obligations and responsibilities of the Company and users in connection with the ferry ticket search and booking service provided through the Service.
Article 2 (Definitions)
- "Service" means the search, fare comparison, ticket booking and payment, and related information for ferry routes worldwide provided on the Ferrynear website.
- "User" means anyone using the Service under these Terms. The Service is used as a guest without an account; bookings are looked up by booking reference and email.
- "Operator" means the shipping company that actually provides the ferry carriage.
- "Booking partner" means Direct Ferries Ltd (UK), through which the Company books and issues tickets.
- "Fare" means the amount shown in Korean won (KRW) on the Service and paid by the User for tickets and extras (cabins, seats, etc.).
Article 3 (Posting and amendment)
(1) The Company posts these Terms and its business details (name, representative, address, telephone, business registration and mail-order registration numbers) on the Service.
(2) The Company may amend these Terms within the limits of applicable law, including the Act on Consumer Protection in Electronic Commerce and the Act on the Regulation of Terms and Conditions.
(3) Amendments are announced on the Service at least 7 days before they take effect, or 30 days before if unfavourable to users, with the effective date and reasons.
(4) Amended Terms apply only to bookings made after the effective date.
Article 4 (The Service)
(1) The Company books and issues Operators’ ferry tickets through the booking partner and collects payment in KRW.
(2) Carriage is provided by the Operator, and the contract of carriage is between the passenger and the Operator. The Operator’s conditions of carriage govern boarding, luggage, pets, vehicles, check-in and other carriage matters.
(3) The Company shows the Operator’s terms or fare rules (summary) with a link to the original. If they differ, the Operator’s original terms prevail.
Article 5 (Booking and formation of contract)
(1) The User applies for a booking by choosing a route, date, sailing and fare, entering passenger details, agreeing to these Terms and the privacy items, and paying.
(2) The booking contract is formed when the payment is approved and the ticket is confirmed by the Operator (through the booking partner). The Company then promptly sends a confirmation email with the booking reference and boarding information.
(3) If a ticket cannot be confirmed after payment (e.g. sold out or an Operator system error), the Company informs the User and refunds the payment in full.
(4) The Company may refuse or cancel a booking made with false or another person’s information.
Article 6 (Fares and payment)
(1) Fares are shown in KRW; the amount shown at the time of payment is the final amount charged.
(2) Operator fares can change in real time. If the fare changes during booking, the Company shows the new amount before payment and proceeds only if the User agrees.
(3) Payments are processed by Toss Payments. Card and other payment details are entered in the payment provider’s window and are not stored by the Company.
Article 7 (No changes)
Once a booking is made, its date, time, sailing and passengers cannot be changed. To travel differently, cancel the booking under the fare’s refund rules and make a new booking.
Article 8 (Cancellation and refunds)
(1) Every fare is either "Refundable" or "Non-refundable", and its refund conditions (cancellation fees, deadlines, etc.) are shown before payment.
(2) Refundable fares are refunded under the fare rules shown before payment and the Operator’s cancellation rules. The amount refunded to the User is proportional to what the Operator (booking partner) refunds: for example, if the Operator refunds 80% of the fare, the User receives 80% of the amount paid.
(3) Non-refundable fares are not refunded on cancellation or no-show.
(4) Users can request a cancellation and refund with the "Request a refund" function in the confirmation email or on the Service’s "Check my booking" page.
(5) Refunds go back to the original payment method. For card payments, it can take about 3–7 business days, depending on the card issuer, for the refund to appear.
(6) If the Operator cancels or delays a sailing, the Operator’s rules on refunds or compensation apply, and the Company assists the User with the refund.
Article 9 (Withdrawal of offer)
(1) A ticket is carriage on a specific date and sailing, issued by the Operator at the time of payment, and cannot easily be resold. Withdrawal may therefore be limited under Article 17(2) of the Act on Consumer Protection in Electronic Commerce; the Company clearly discloses this and the fare’s refund rules before payment and obtains the User’s agreement. Cancellations and refunds then follow Article 8.
(2) Notwithstanding (1), if the service provided differs from what was displayed or advertised or from the contract, the User may withdraw within 3 months of receiving the service and within 30 days of learning, or being able to learn, of the difference (Article 17(3) of the same Act).
Article 10 (User obligations)
- Users must enter accurate passenger names (in English, as in the passport), contact details and route-specific information. Users are responsible for consequences of incorrect information, such as being refused boarding.
- Passports, visas, entry documents, vehicle documents and any other documents needed to travel and board are the User’s responsibility.
- Users must meet the Operator’s check-in and boarding deadlines.
- Users must not use the Service for unlawful purposes or infringe the rights of the Company or others.
Article 11 (Company obligations)
- The Company complies with applicable law and these Terms and strives to provide the Service reliably.
- The Company shows fares, refund rules, Operator terms and other information needed to decide before payment.
- The Company protects users’ personal information under its Privacy Policy.
- The Company handles enquiries and complaints received by telephone and KakaoTalk promptly.
Article 12 (Limitation of liability)
(1) Matters arising during carriage — cancellations, delays, route changes, damaged or lost luggage, etc. — are governed by the Operator’s conditions of carriage.
(2) The Company is not liable when it cannot provide the Service due to force majeure, such as natural disasters, war, epidemics, strikes, severe weather or government action.
(3) The Company is not liable for losses caused by the User, such as incorrect information or missing travel documents.
(4) Paragraphs (1) to (3) do not apply to losses caused by the Company’s intent or gross negligence.
Article 13 (Personal information)
The Company collects only the personal information needed to provide the Service; its processing is described in the Privacy Policy.
Article 14 (Dispute resolution)
(1) The Company strives to reflect users’ legitimate opinions and complaints and to compensate damage.
(2) Disputes follow the Consumer Dispute Settlement Criteria under the Framework Act on Consumers, and users may apply for mediation to the Korea Consumer Agency or other mediation bodies.
Article 15 (Governing law and jurisdiction)
These Terms and disputes about the Service are governed by the laws of the Republic of Korea, and the court with jurisdiction under the Civil Procedure Act has jurisdiction.
Supplementary provision: These Terms take effect on 2026-10-29.
